1. Introduction and Scope
These Terms of Service ("Terms") govern your access to and use of the website located at www.thelawmother.com and any related pages, forms, or online services operated by Law Mother, LLC ("Law Mother," "we," "us," or "our") (collectively, the "Site"). The Site includes intake forms through which you may submit information about a potential legal matter.
By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.
2. Acceptance of Terms
You must be at least 18 years of age and legally capable of entering into a binding agreement to use the Site or submit any intake form. By using the Site, you represent that you meet these requirements. If you are using the Site on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.
3. Consent to Contact
By submitting an intake form on the Site and providing your electronic signature on the disclosure presented at submission, you provide your express written consent for Law Mother, LegalFlare, LegalFlare's network of participating law firms, and parties calling on their behalf to contact you at the telephone number(s) and email address(es) you have provided.
Such contact may include:
- Autodialed calls;
- Prerecorded or artificial voice messages;
- SMS and MMS text messages; and
- Email.
The subject matter of such contact will relate to legal services that may be of interest to you, including matters that arise from review of the information you submit.
Consent is not a condition of any purchase or of legal representation. Message and data rates may apply. Message frequency varies.
You may reply STOP to any text message to opt out of further text messages, or HELP for assistance. You may also revoke your consent at any time by contacting us using the information in Section 20 (Contact). Revocation of consent will not affect the lawfulness of contact made before revocation is processed.
4. Referral and Co-Counsel Arrangement
Law Mother may, in its discretion, refer matters submitted through the Site to LegalFlare and to LegalFlare's network of participating plaintiff law firms for evaluation and possible representation. By submitting an intake form, you acknowledge and agree that:
(a) Information you submit may be transmitted to LegalFlare and shared with one or more participating law firms in LegalFlare's network for the purpose of evaluating whether one or more of those firms can assist with your potential matter;
(b) If a participating firm undertakes representation, that representation may be on a joint, associated, or co-counsel basis with Law Mother and/or other firms in the network, subject to applicable rules of professional conduct;
(c) Any division of attorneys' fees among Law Mother, LegalFlare-affiliated counsel, and/or participating network firms will be made in accordance with the rules of professional conduct of the applicable jurisdiction(s), including, where required, written disclosure to and written consent from the client; and
(d) Neither Law Mother nor any firm in the network is obligated to accept your matter, and your submission does not guarantee that any firm will agree to represent you.
5. No Attorney-Client Relationship
Submitting an intake form, communicating with Law Mother through the Site, or otherwise using the Site does not create an attorney-client relationship between you and Law Mother, LegalFlare, or any participating law firm. An attorney-client relationship is formed only upon the execution of a written engagement or representation agreement signed by both you and the attorney or firm undertaking the representation.
Until such an agreement is signed:
(a) No attorney is acting on your behalf;
(b) No legal advice is being provided to you, and no information communicated through the Site should be relied on as legal advice;
(c) No statute of limitations or other deadline applicable to your potential matter is being preserved by Law Mother or any other party; and
(d) You remain solely responsible for taking timely action to protect your legal rights, including consulting independent counsel.
6. Confidentiality is Not Guaranteed
Information transmitted through the Site is not subject to the attorney-client privilege until an attorney-client relationship has been formed. You should not transmit confidential or sensitive information through the Site beyond what is reasonably necessary to enable evaluation of your potential matter.
7. User Representations and Warranties
By submitting any information, document, image, or other content through the Site (a "Submission"), you represent and warrant that:
(a) The information contained in your Submission is true, accurate, and complete to the best of your knowledge;
(b) You own or otherwise have the right to submit the Submission and to authorize its use as described in these Terms and the Privacy Policy;
(c) Your Submission does not infringe, misappropriate, or violate the intellectual property rights, privacy rights, publicity rights, or other rights of any third party;
(d) Your Submission does not contain unlawful, defamatory, harassing, or otherwise tortious content; and
(e) You have not been induced to make any Submission by any promise or representation regarding the outcome of any potential legal matter.
You grant Law Mother, LegalFlare, and participating network law firms a non-exclusive, royalty-free license to use, store, transmit, reproduce, and analyze your Submission for the purpose of evaluating, referring, and (if applicable) representing you in connection with the matter described.
8. Site Use and Restrictions
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
(a) Reproduce, distribute, publicly display, sell, lease, or otherwise transfer the Site or any portion of it;
(b) Adapt, alter, modify, reverse engineer, disassemble, or decompile the Site or any software underlying the Site;
(c) Use any automated means (including bots, scrapers, or crawlers) to access the Site or extract data from it;
(d) Interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available;
(e) Submit information that you know to be false, misleading, or fraudulent; or
(f) Use the Site to transmit any virus, malware, or other harmful code.
9. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is the property of Law Mother or its licensors and is protected by United States and international intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from any portion of the Site without prior written consent.
10. Disclaimer of Warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, LAW MOTHER, LEGALFLARE, AND THE PARTICIPATING NETWORK LAW FIRMS DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. NO INFORMATION OBTAINED FROM THE SITE CONSTITUTES LEGAL ADVICE OR CREATES ANY WARRANTY THAT YOUR POTENTIAL CLAIM HAS MERIT OR WILL BE ACCEPTED FOR REPRESENTATION.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, UNDER NO CIRCUMSTANCES SHALL LAW MOTHER, LEGALFLARE, ANY PARTICIPATING LAW FIRM, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND ARISING FROM OR RELATED TO YOUR ACCESS TO OR USE OF THE SITE, EVEN IF SUCH PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF LAW MOTHER ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE EXCEED ONE HUNDRED U.S. DOLLARS ($100).
12. Indemnification
You agree to defend, indemnify, and hold harmless Law Mother, LegalFlare, the participating network law firms, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) any Submission you make; (c) your breach of these Terms; or (d) your violation of any law or the rights of any third party.
13. Third-Party Websites
The Site may contain links to websites operated by third parties. Such links are provided for convenience only and do not constitute an endorsement. Law Mother is not responsible for the content, policies, or practices of any third-party website.
14. State Laws Vary; Advertising Disclosures
The laws governing legal services, attorney advertising, and client solicitation vary by jurisdiction. The Site is intended for residents of the United States. Nothing on the Site is intended to constitute the practice of law in any jurisdiction in which Law Mother or its participating network firms are not authorized to practice. The Site may constitute attorney advertising under the rules of certain jurisdictions. Prior results do not guarantee a similar outcome.
15. Modifications to the Terms
We reserve the right to update, amend, modify, or revise these Terms at any time in our sole discretion. The "Last Updated" date at the top of these Terms reflects the most recent revision. Your continued use of the Site after any such change constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Site.
16. Arbitration and Dispute Resolution
Any and all claims, disputes, or controversies arising out of or relating to the Site, these Terms, or your use of the Site (other than (i) claims for injunctive or other equitable relief and (ii) any dispute concerning the existence, scope, or enforceability of an attorney-client relationship, attorney malpractice, or attorneys' fees, which shall be governed by applicable rules of professional conduct and law) shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules then in effect.
The arbitration shall be conducted in Englewood, Colorado before a single arbitrator. Judgment on the award rendered may be entered in any court of competent jurisdiction.
Class Action Waiver. To the fullest extent permitted by law, you and Law Mother each agree that any claims will be brought in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
17. Governing Law and Jurisdiction
These Terms and any dispute arising out of or relating to them or the Site shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict-of-laws principles. Subject to Section 16, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Arapahoe County, Colorado for any action not subject to arbitration.
18. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
19. Entire Agreement; Waiver
These Terms, together with the Privacy Policy and the consent disclosure presented at form submission, constitute the entire agreement between you and Law Mother regarding the Site and supersede any prior agreements. Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision.
